What this covers
Disputes that come out of an estate.
Most of these cases start with a document nobody expected or an accounting that does not add up. We look at the paper first, tell you what the claim is actually worth, and move accordingly.
01
Will contests
Capacity, undue influence, and improperly executed documents.
02
Trust disputes
Interpretation, distributions withheld, and trustee conduct.
03
Removal actions
Removing a personal representative or trustee who is not performing.
04
Breach of fiduciary duty
Self-dealing, missing assets, and claims for surcharge.
05
Accounting objections
Challenging an accounting, or defending one you prepared.
06
Guardianship disputes
Contested petitions and disagreements between family members.
How we help
From demand to resolution.
01
Case review
We read the documents and give you an honest read on the claim.
02
Demand or petition
Many matters resolve with a letter. If not, we file.
03
Discovery
Records, depositions, and the accounting that usually decides it.
04
Mediation or trial
Most cases settle at mediation. We prepare as if they will not.
COMMON QUESTIONS
Questions we hear first.
If yours is not here, call the office. Someone who works on these matters will answer.
How long do I have to contest a will?
Short deadlines apply once you receive formal notice, sometimes as little as three months. Call as soon as you get court paperwork.
Can I make the trustee show me records?
Beneficiaries are generally entitled to accountings and information. If requests are ignored, the court can compel it.
Who pays for this?
Depends on the claim. In some cases fees can be paid from the estate or trust. We explain the options before filing.
Will this destroy the family?
That is a real concern and we treat it seriously. Sometimes the fastest way to end a fight is to file. Often it is not.
