What this covers
Getting appointed, and staying compliant.
Guardianship is a last resort. When a power of attorney was never signed, or is no longer being honored, this is the path. The appointment is the beginning, not the end, because the court supervises what follows.
01
Adult guardianship
Petition, examining committee, and appointment for an incapacitated adult.
02
Minor guardianship
For a child who inherits money or whose parents cannot serve.
03
Emergency temporary
Short-term authority when someone is at immediate risk.
04
Guardian advocacy
A lighter alternative for adults with developmental disabilities.
05
Annual reporting
Plans and accountings the court requires every year.
06
Restoration of rights
Ending or narrowing a guardianship when capacity returns.
How we help
Petition to appointment.
01
Assess alternatives
If a power of attorney will work, we say so and stop there.
02
File the petition
Petition for incapacity and appointment, with notice to the family.
03
Hearing
The examining committee reports and the court decides scope.
04
Ongoing duties
Inventory, plan, and annual accountings, prepared with you.
COMMON QUESTIONS
Questions we hear first.
If yours is not here, call the office. Someone who works on these matters will answer.
Can we avoid guardianship?
Sometimes. A valid durable power of attorney and health care surrogate often cover the same ground at a fraction of the cost.
Who can serve as guardian?
Usually a family member. The court considers conflicts, criminal history, and whether anyone objects.
What if the family disagrees?
Contested guardianships happen. The court can appoint a professional guardian if no family member is suitable.
How long does the guardianship last?
Until the person regains capacity, dies, or the court modifies it. Annual reporting continues throughout.
